This Privacy Notice to California Residents (this "Notice") supplements the information contained in our general Privacy Policy and applies solely to individuals who reside in the State of California ("consumers" or "you"). We adopt this Notice to comply with the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (together, the "CCPA"), and other California privacy laws.

Who This Notice Applies To
This Notice applies to Elmwood Dental Group, P.C. ("we," "us," "our," or the "Service"), a dental practice located at 1950/1960 S. Clinton Ave., Rochester, New York 14618.

Scope and Health Information Exclusion
Elmwood Dental is a covered entity under HIPAA. Some information we maintain about patients is protected health information governed by HIPAA and the California Confidentiality of Medical Information Act ("CMIA"). The CCPA does not apply to that medical information, and this Notice does not cover it; it is addressed by our Notice of Privacy Practices. This Notice covers Personal Information collected outside those frameworks, for example through this website, our marketing and appointment forms, analytics tools, and advertising activities.

1. Information We Collect
Within the last twelve (12) months, the Service has collected the following categories of Personal Information:

Personal Information does not include publicly available government records, deidentified or aggregated information, or information excluded from the CCPA's scope (such as health information covered by HIPAA and the CMIA, or information covered by the FCRA, GLBA/FIPA, or DPPA).

Sources of Personal Information

  • Directly from you, through the Service, appointment and patient forms, and correspondence by mail, email, text message, or phone.
  • Indirectly from you, by observing your actions on the Service through cookies, pixels, and analytics technologies.
  • From third parties, such as advertising networks, analytics providers, and social networking services you integrate with the Service.
  • Communications and messaging service providers
  • Professional advisors, such as auditors and attorneys
  • Legal, regulatory, and law enforcement authorities, where required

2. Sensitive Personal Information
Under the CCPA, we do collect sensitive personal information.  To the extent any health-related information you submit through this website falls outside HIPAA and the CMIA, we use it only to respond to your inquiry and to schedule care.

3. Use of Personal Information
We may use or disclose Personal Information to respond to inquiries and schedule appointments; to provide, support, and improve the Service; to secure our records; to prevent fraud; to personalize content and deliver relevant advertising; for research and product development; to communicate with you; to maintain security; to comply with law; and in connection with a business transfer.

4. Disclosure, "Selling," and "Sharing" of Personal Information
We disclose Personal Information to service providers and contractors for business purposes under contracts requiring confidentiality.

Because we use third-party advertising and analytics technologies (such as the Meta Pixel and Google Analytics) that may transmit online identifiers and internet activity for cross-context behavioral advertising, these activities may be considered "sharing" or "selling" under the CCPA. You have the right to opt out (see Section 6).

In the preceding twelve (12) months, we may have "sold" or "shared" Category A (Identifiers), Category F (Internet activity), and Category G (Geolocation data). We do not knowingly sell or share the Personal Information of consumers under 16 years of age.

5. Disclosures for a Business Purpose
In the preceding twelve (12) months, we have disclosed Categories A, B, D, F, and G for a business purpose to service providers and contractors.

6. Your Rights and Choices

  • Know / Access. Request disclosure of the categories and specific pieces of Personal Information, the sources, purposes, and third parties.
  • Data Portability. Receive the specific pieces of Personal Information in a readily usable format.
  • Delete. Request deletion, subject to certain exceptions.
  • Correct. Request correction of inaccurate Personal Information.
  • Opt Out of Sale or Sharing. Direct us not to sell or share your Personal Information. We honor Global Privacy Control (GPC) signals.
  • Limit Use of Sensitive Personal Information. Direct us to limit use of sensitive personal information to permitted purposes.
  • Non-Discrimination. Not receive discriminatory treatment for exercising your rights.

7. Exercising Your Rights
Submit a verifiable consumer request by calling (585) 461-4350, emailing privacy@elmwooddental.com, or using our online form. To opt out of sale or sharing, please call (585) 461-4350. Only you or an authorized agent may make a request, and we must be able to verify your identity.

8. Response Timing and Format
We endeavor to respond within forty-five (45) days, extendable by an additional forty-five (45) days with notice. Disclosures cover the preceding twelve (12) month period. We do not charge a fee unless a request is excessive, repetitive, or manifestly unfounded.

9. Non-Discrimination
We will not discriminate against you for exercising your CCPA rights, and we do not offer financial incentives in exchange for the retention or sale of Personal Information.

10. Other California Privacy Rights ("Shine the Light")
California's "Shine the Light" law (Cal. Civ. Code 1798.83) permits California residents to request information about disclosures for third parties' direct marketing purposes. To make such a request, email privacy@elmwooddental.com.

11. Changes to This Policy
We may revise these Terms from time to time. When we do, we will update the “Last Updated” date above and post the current version on this Site. Your continued use of this Site after changes are posted constitutes acceptance of the revised Terms.
